Dan said (albeit in a liveshow that would not be broadcast throughout the phandom) that people could download it off the video for free, and if anyone wanted it, he gave his premission to do so, and that recording could then be shared I assume. 3. Perhaps not all, but a number of those who bought the 'single' on itunes, probably did so believing they were supporting Dan, not some 'prankster for profit'. Can they receive refunds due to fraud?

Totally agree - whoever this is planned to make some money off of it. If it was just a prank they could have put it on itunes for free. I don't feel sorry for people who commit fraud.

I'm not well-acquainted with iTunes and didn't know you could put things on it for free. That puts a different spin on it. And yeah, fraud is serious business.

I don't think Dan is proud of this at all. I actually think he's terrified/embarrassed, at least that's what his reaction makes me assume.

1) He tried not to bring any extra attention to it by not actually tweeting about it, only replying to people so that only those who check his replies see it. He could have easily tweeted a short statement that the track on iTunes isn't intentional and maybe made a joke about how high it climbed. If he was proud or wanted it to climb higher, that would have been a way to let people know and possibly get more people to buy (as a joke).

2) He did reply to quite a few people, making a lot of jokes. IMO it looks like he's trying to really drive it home that the track is just a joke and really wants to make sure nobody thinks he wanted to sell it.

I guess he's afraid some actual musicians listen to it, now that it's a top 10 song and that's probs not the kind of attention he wanted from his senpais.

If there was ever a time for him to find IDB, it was while writing his roast. Didn't some people say that Emma's roast was basically her GG thread in a nutshell? I guess GG would be the first place for a youtuber to go to when writing their roast, so isn't it quite likely that Dan checked out his GG thread? If so, how likely is it that he realized it's unexplainably dead and found IDB?
And i agree with those saying he wouldn't like this place. Well meaning or not, the archiving alone is gonna make him hate our guts

Am I the only one that feels kind of bad for whoever put it up? Obviously shame on them and that's a bad thing to do, and if their goal was to really profit from it then yeah, that's bad and horrible on a lot of different levels and they kind of deserve the backlash. Alternatively, I can't help but think this could potentially just be some teenage kid who didn't know any better and was just trying to pull a funny joke that they thought everyone would laugh at, but now they're getting lawyers threatened at them.

No, I feel kind of bad for them, too. As soon as I saw it, I thought a fan put it up as a joke... didn't realise the legal ramifications immediately. Kids on the internet try a lot of stupid stunts for attention (not saying everything they do online is for attention, but you know what I mean). I think maybe whoever put it up did it as an inside joke with friends ... i.e. "I'm going to put Dan's diss track on iTunes just for kicks; maybe it'll beat Kanye lmao." But yeah, if it was a fan, they definitely didn't think through the consequences of impersonating Dan and uploading a stolen song to iTunes for money. Like, you can get sued for that kind of stuff.

I also thought the cover art and title were quite obviously not Dan; can't understand how people could legitimately buy it. Maybe they didn't know about what he said in the ls ... but really. It's not his style, and you can rip it from the video anyway.

I agree with this. I do think it's likely the track was put up by a fan or someone who didn't really consider the consequences.
If it was put up with the explicit intent to profit out of Dan's popularity, that's another story.
In general I think Deppy only involve themselves with IP breaches if they think it's a cheap way to profit from the fanbase (and even then they must know about redbubble and other sites and so far quietly condone it)

I wonder what they'll do. My theory is that they will probably ask someone from flipside to act on their behalf and contact Itunes. The track already made the top charts so i can't see them turn a blind eye to what happens to the money. I suspect Itunes still has to pay out the money from the track sales to the 'artist' and it can be solved internally. If not ... yea I hope they will contact the person (or his family if it's a minor) and if no solution is found (which would surprise me) i think they will sue. A settlement can still be reached at any point.

Basically, i expect them to act like nice guys about it, trying to solve the issue first without going to court, but steadfast in the worst case scenario where this is a shameless attempt to profit from others.

As said before, it's also important to keep perspective. It's a 99 cent rip off, honestly i do'nt even think most people that buy it really care who's it from and it would be glorious if he could beat Kanye
Ya know, I hope this turns out to be an extra motivation for Dan to diss his inner full time internet hobo and put the god damn track on itunes himself. This would be pefect charity stuff. Clearly, there is a need and an audience for his raps

Yea those are keen observations. I'm not sure how embarrassed DJ Howell really is about other musicians hearing it though. He's going to release a dvd of his vaudeville show with plenty of singing and dancing, he's all in at this point

Yea the IDB mention... i want to be wrong but looking at his facial reaction after the shout out.. i did not really see glimpse of recognition. He seems to react exactly the same way as is other shoutouts, transitioning into that daft but hilarious smile.
The only thing that makes me doubt it is that i don't think he would just should out an organization (because IDB clearly is'nt just a name) which he knows nothing about.

Agree. I think what hit me the most is the fact that they monetize it and manipulating the fanbase who is known into being very supportive, so I don't feel sorry for the culprit.

My immediate reaction to #itunesgate was some cheater was blatantly trying to profit from Dan's work. But the fan-gone-wild theory also has merit. If some young teen did it, I'm sure that they don't understand the ramifications of their actions. However, an older teen probably does (whether they care or not is another matter.) Anyway, FlipSide is already all over this as evidenced by their tweet, as they have a financial interest as well as Dan. The thing that sucks is Dan is going to be spending some money in legal fees to protect his intellectual property - FlipSide will charge its legal expenses to Dan's accounts in addition to its normal commission from all his works (agency contracts normally get a cut from all works from an artist, even if they didn't bring the work to the artist in the first place,) and Dan might also have his personal (independent from FlipSide) counsel involved as well. Hopefully this can all be settled before too many billable hours are expended.

I actually think he would be embarrassed. TATINOF is something he has spent almost two years of his life laboring over and perfecting, and spent weeks - or longer - assisting professionals with the editing process. The song is something he wrote and recorded in a matter of days with the understanding that the audience watching it would it already have a concept of who he is and be aware of the context (the RYC youtube challenge). Having it go on itunes where tons of people who aren't even his general audience or in the youtube community at all (including people Dan himself admires as artists) might see it, be curious, and click could be embarrassing.

I don't think this is going to cost Dan money. I think it will be as simple if flipside contacting iTunes stating the song is the property of their client and he did not upload it and then iTunes have to fix it from there. The person uploaded it as Dan so it's not like there will even be a dispute to establish its his work it clearly belongs to Dan he just has to state it wasn't him who put it there. It really shouldn't require much work on Dan and flipsides part unless Dan actually wanted to take legal action against the person who uploaded it (which isn't going to happen considering it's likely a teenage "fan").
